Website Terms of Use

Last Updated: July 28, 2026

These Website Terms of Use (“Terms”) govern your access to and use of www.arcaneandivory.com and any related webpages, forms, digital platforms, online shops or services operated by Arcane & Ivory.

The website and its contents are owned and operated by Arcane & Ivory, a registered partnership operating under the laws of Alberta, Canada (“Arcane & Ivory,” “we,” “us” or “our”).

In these Terms, “you” and “your” refer to the person accessing or using the Site. If you access or use the Site on behalf of another individual, business or organization, you represent that you have authority to accept these Terms on their behalf.

Please read these Terms carefully before using our Site, submitting an inquiry, purchasing a product or accessing any of our offerings.

By accessing or continuing to use the Site, submitting information through the Site, purchasing a Product or clicking to accept these Terms when that option is provided, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Site.

1. DEFINITIONS

For the purposes of these Terms:

“Site” means www.arcaneandivory.com and any webpages, online forms or digital storefronts operated by Arcane & Ivory.

“Services” means wedding planning, partial planning, final-month coordination, wedding-day coordination, intimate wedding planning, elopement planning, themed wedding planning, virtual planning support, stationery design, event design, décor rentals, consultation services and any other service offered by Arcane & Ivory.

“Products” means digital or physical products offered by Arcane & Ivory, including invitations, stationery, templates, signs, printable materials, colouring pages, guides, planning resources and other downloadable, customized or physical items.

“Content” means all text, photographs, videos, graphics, illustrations, templates, downloads, designs, logos, branding, page layouts, resources and other materials displayed or made available through the Site.

2. ELIGIBILITY

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase Products, book Services or enter into a client agreement with Arcane & Ivory.

Individuals under 18 may browse the Site only with the involvement and supervision of a parent or legal guardian.

If you use the Site on behalf of another person, business or organization, you confirm that you have authority to bind that person, business or organization to these Terms.

3. USE OF THE SITE

You may use the Site only for lawful, personal and non-commercial purposes, including learning about Arcane & Ivory, submitting an inquiry and purchasing Products or Services for your own wedding, celebration or event.

You agree to provide information that is current, complete and accurate when submitting an inquiry, purchasing a Product or communicating with us.

You must not:

  • use the Site for an unlawful, fraudulent or misleading purpose;

  • impersonate another person or misrepresent your identity or authority;

  • attempt to gain unauthorized access to the Site, its servers, accounts or connected systems;

  • introduce viruses, malicious code or other technologically harmful materials;

  • scrape, copy, harvest or extract Site Content through automated or manual methods;

  • interfere with the operation, security or availability of the Site;

  • use the Site to transmit spam or unsolicited commercial communications;

  • use our Content, Products or designs to create competing or substantially similar products or services; or

  • encourage or assist another person in carrying out any prohibited activity.

We may restrict, suspend or terminate your access to the Site if we reasonably believe you have violated these Terms or used the Site in a harmful, abusive, fraudulent or unlawful manner.

4. INFORMATION ABOUT OUR SERVICES

Information displayed on the Site is provided for general informational and promotional purposes.

Descriptions of our Services, packages, inclusions, add-ons, timelines and starting prices may change from time to time. We make reasonable efforts to ensure that the information on our Site is accurate; however, we do not guarantee that all information will always be complete, current or error-free.

Submitting an inquiry, consultation request or contact form does not create a client relationship and does not reserve an event date.

An event date is not considered booked unless:

  1. Arcane & Ivory has confirmed availability;

  2. all required parties have signed the applicable client agreement; and

  3. the required retainer or initial payment has been received.

We reserve the right to decline an inquiry or booking request at our discretion, including when we are unavailable, the requested Services fall outside our scope, the event presents an unreasonable safety concern or the parties are not a suitable professional fit.

5. CLIENT AGREEMENTS

Wedding planning, coordination, custom stationery, décor rental and other customized Services may require a separate written client agreement.

The client agreement may contain additional provisions concerning:

  • the scope of Services;

  • package inclusions and exclusions;

  • event dates and service periods;

  • payment schedules and retainers;

  • cancellations, postponements and refunds;

  • client responsibilities;

  • communication expectations;

  • revisions and approvals;

  • vendor relationships;

  • travel and accommodation;

  • décor pickup, delivery, setup and return;

  • photography and portfolio permissions;

  • limitation of liability; and

  • circumstances beyond the parties’ reasonable control.

If there is a conflict between these Terms and a signed client agreement, the signed client agreement will govern in relation to the specific Services covered by that agreement.

6. PRICING AND PAYMENTS

Unless otherwise stated, prices displayed on the Site are in Canadian dollars.

Prices may exclude applicable taxes, delivery costs, travel expenses, accommodation, third-party charges, printing, shipping or other expenses. Any additional costs will be identified in the applicable proposal, invoice, product listing, checkout page or client agreement.

We reserve the right to update our prices and offerings at any time. A pricing change will not alter a signed client agreement unless the agreement permits the change or the parties agree to it in writing.

Payments may be processed through third-party payment processors. Arcane & Ivory does not directly store complete payment-card information when payments are processed by a third-party provider.

You agree to provide accurate billing and payment information and authorize the applicable payment processor to charge the amount shown at checkout or on your invoice.

If a payment is declined, reversed, disputed or subject to a chargeback, we may suspend delivery, access or performance until the issue is resolved.

7. RETAINERS, CANCELLATIONS AND REFUNDS

Retainers, deposits, payment schedules, cancellations, postponements, rescheduling and refunds for wedding planning, coordination, custom design and rental Services are governed by the applicable proposal, invoice and signed client agreement.

Refund terms for Products are governed by the applicable product listing, checkout terms or written agreement.

Because digital Products are delivered electronically and may be accessed or downloaded immediately, digital purchases may be non-refundable once delivery, access or downloading has occurred, except where a refund or cancellation right is required by applicable law.

Customized or personalized Products may be non-refundable once design work, customization, production or printing has begun, except where otherwise stated in writing or required by applicable law.

Nothing in these Terms limits any cancellation, refund, warranty or consumer protection right that cannot legally be waived or excluded.

8. DIGITAL PRODUCTS AND LICENSING

When you purchase or receive a digital Product, you are purchasing a limited licence to use that Product. Ownership of the Product and its underlying intellectual property does not transfer to you.

Unless a product listing or written licence expressly states otherwise, Arcane & Ivory grants you a limited, revocable, non-exclusive and non-transferable licence to use the digital Product for your personal wedding, celebration or event.

You may:

  • download and store the files for your personal use;

  • print reasonable quantities for your own wedding, celebration or event;

  • provide finalized files to a printer solely for producing your personal order;

  • share finalized materials with your venue or event vendors when reasonably required for your event; and

  • distribute invitations, programs, signs or other finished materials to your own invited guests for their intended purpose.

You may not:

  • resell, sublicense, redistribute or commercially exploit a digital Product;

  • share editable templates, source files, download links or account access with another person;

  • claim that the Product or design was created by you;

  • copy or modify a Product to create another product for sale or distribution;

  • use a Product to provide design, stationery or event services to a third party;

  • upload a Product to a template marketplace, print-on-demand platform, shared drive, membership library or stock-content website;

  • remove copyright, trademark or ownership notices;

  • register any part of a Product as your own copyright, trademark or other intellectual property; or

  • use a Product for unlawful, defamatory, discriminatory or misleading purposes.

Purchasing one Product does not grant a licence for multiple unrelated weddings, clients, businesses or events unless the listing expressly permits such use.

We may revoke your licence if you violate these Terms. Revocation does not entitle you to a refund.

9. CUSTOM STATIONERY AND DESIGN SERVICES

Custom and semi-custom stationery may involve client-provided names, dates, wording, photographs, venue information and other event details.

You are responsible for reviewing and approving all proofs before printing, publishing or final delivery. Your approval confirms that you have checked spelling, grammar, names, dates, times, addresses, colours, quantities, dimensions and all other details.

Arcane & Ivory is not responsible for errors that were present in an approved proof.

Colours may appear differently across screens, devices, paper stocks, printing methods and production batches. Slight variations in colour, texture, placement, trimming and finish may occur and are not necessarily considered defects.

Fonts, stock images, illustrations, software, mockups and other third-party elements may remain subject to the intellectual property rights and licence terms of their respective owners.

Additional revisions beyond the number included in your package may require an additional fee.

10. DÉCOR RENTALS AND PHYSICAL ITEMS

Décor rentals and physical items may be subject to a separate rental agreement, inventory list, condition report, security deposit, replacement value, pickup arrangement or delivery fee.

Rental availability is not guaranteed until confirmed in writing.

You are responsible for using rental items only for their intended purpose and for returning them on time and in substantially the same condition in which they were received, allowing for ordinary wear where applicable.

Charges may apply for late returns, missing pieces, excessive cleaning, damage, loss or replacement, as described in the applicable rental agreement.

Product photographs are provided for general reference. Actual colours, materials, dimensions and appearance may vary slightly.

11. INTELLECTUAL PROPERTY

All Content displayed or made available through the Site is owned by Arcane & Ivory or used under licence, unless otherwise identified.

This includes our:

  • business name and logo;

  • branding and colour combinations;

  • website design and page layouts;

  • photographs and styled mockups;

  • written copy and package descriptions;

  • stationery designs and templates;

  • signs and decorative concepts;

  • illustrations and graphics;

  • planning materials, questionnaires and checklists;

  • downloads, guides and resources; and

  • social-media content.

The Content is protected by Canadian and international copyright, trademark and other intellectual property laws.

Except for the limited use expressly permitted by these Terms, you may not reproduce, copy, publish, display, modify, translate, distribute, sell, license, create derivative works from or commercially exploit our Content without our prior written permission.

You may share a link to a public page of our Site, provided that you do not suggest that Arcane & Ivory sponsors, endorses or is affiliated with you without our written consent.

12. USER-SUBMITTED CONTENT

You may choose to provide us with photographs, wording, reviews, testimonials, inspiration images, design materials or other content in connection with an inquiry, purchase or Service.

You represent that:

  • you own the submitted content or have permission to provide it to us;

  • our authorized use of it will not violate another person’s copyright, trademark, privacy or other rights; and

  • the content is not unlawful, defamatory, abusive, discriminatory, obscene or malicious.

You grant us permission to use submitted content only as reasonably necessary to respond to your inquiry, provide the requested Product or Service, maintain business records and meet our legal obligations.

Submitting content through the Site does not automatically give Arcane & Ivory permission to use your photographs, likeness, wedding details or private event materials for advertising, social media or portfolio purposes. Any marketing or portfolio use will be governed by a separate written permission, release or client-agreement provision.

13. REVIEWS AND TESTIMONIALS

Reviews and testimonials displayed on the Site reflect the personal experiences and opinions of the individuals who provided them.

Individual experiences may vary, and a testimonial does not guarantee that another client will receive the same outcome or experience.

We may make minor edits to a testimonial for spelling, grammar, clarity or length, provided that we do not materially change its meaning.

Any compensated, discounted or gifted testimonial will be identified where required by law.

14. VENDORS AND THIRD-PARTY SERVICES

Arcane & Ivory may provide vendor recommendations, referrals, website links or contact information as a convenience.

Unless expressly stated in a signed agreement, recommended vendors are independent third parties and are not employees, agents, partners or subcontractors of Arcane & Ivory.

You are responsible for independently reviewing and selecting your vendors and for entering into contracts directly with them.

We do not guarantee a vendor’s:

  • availability;

  • pricing;

  • qualifications;

  • licensing or insurance;

  • workmanship;

  • communication;

  • performance;

  • safety;

  • financial stability; or

  • compliance with their agreement.

Arcane & Ivory is not responsible for the conduct, acts, omissions, products, services, delays, cancellations or failures of an independent vendor or third party.

The Site may contain links to third-party websites or applications. We do not control those websites and are not responsible for their content, policies, availability, security or practices. Accessing a third-party website is at your own discretion and risk.

15. THIRD-PARTY PLATFORMS

We may use third-party platforms for website hosting, email, online forms, scheduling, file delivery, digital downloads, analytics, printing, shipping, payment processing or other business operations.

Your use of a third-party platform may also be governed by that provider’s terms and privacy policy.

Although we select third-party providers that we believe are appropriate for our business, we do not control their systems and cannot guarantee that they will always be uninterrupted, secure or error-free.

16. PRIVACY AND PERSONAL INFORMATION

Our collection, use, disclosure, retention and protection of personal information are described in our Privacy Policy.

By using the Site or submitting information to us, you acknowledge that information may be processed through third-party service providers used to operate our business.

Please do not submit unnecessary sensitive personal information through public contact forms, social-media comments or direct messages.

Questions or requests concerning your personal information may be sent to:

info@arcaneandivory.com

17. ELECTRONIC COMMUNICATIONS

By contacting Arcane & Ivory, submitting an inquiry or purchasing a Product or Service, you consent to receiving transactional and service-related communications concerning your request, purchase, account, consultation or event.

These communications may include confirmations, invoices, questionnaires, reminders, proofs, file-delivery notices and other information necessary to provide the
requested Product or Service.

We will send marketing or promotional emails only where permitted by applicable law. You may unsubscribe from promotional communications by using the unsubscribe option included in the message or contacting us at info@arcaneandivory.com.

Unsubscribing from promotional emails will not prevent us from sending necessary transactional, contractual or service-related communications.

18. WEBSITE AVAILABILITY AND SECURITY

We use commercially reasonable efforts to maintain the Site and protect information within our control. However, no website, electronic transmission or storage system can be guaranteed to be completely secure or continuously available.

We do not guarantee that the Site will always be:

  • uninterrupted or available;

  • free from delays or technical errors;

  • compatible with every device or browser;

  • free from viruses or harmful components; or

  • protected against every unauthorized access attempt.

You are responsible for using appropriate device security, maintaining backups and protecting any passwords or account credentials associated with third-party platforms.

Please notify us promptly at info@arcaneandivory.com if you believe there has been unauthorized activity involving your communications or purchases.

19. ARTIFICIAL INTELLIGENCE-ASSISTED CONTENT

Arcane & Ivory may use artificial intelligence-assisted tools as part of its internal creative, administrative, editing, concept-development or mockup process.

Any AI-assisted material used in our business is reviewed, selected and modified by us as appropriate. However, concept images, styled mockups and illustrative materials may not perfectly represent the appearance of a final printed item, décor setup or completed event.

Unless expressly included in a signed agreement, a concept image or inspiration rendering is not a guarantee that an event, venue, Product or décor arrangement will appear exactly as shown.

20. GENERAL INFORMATION DISCLAIMER

The Site may contain wedding-planning suggestions, checklists, estimated timelines, pricing examples, design inspiration or other general information.

This Content is provided for general informational purposes and is not legal, financial, tax, insurance, medical or other regulated professional advice.

You remain responsible for obtaining advice from appropriately qualified professionals concerning your circumstances.

21. NO GUARANTEED EVENT OUTCOME

We aim to provide thoughtful, organized and professional Services. However, weddings and events involve numerous circumstances and third parties that may be outside our control.

Unless expressly stated in a signed client agreement, we do not guarantee:

  • a particular aesthetic or emotional outcome;

  • specific weather conditions;

  • vendor availability or performance;

  • guest attendance or behaviour;

  • venue access or condition;

  • uninterrupted utilities or technology;

  • the approval of permits or licences;

  • adherence to a timeline by every participant;

  • the availability of specific flowers, décor, paper, materials or products; or

  • that an event will proceed without delays, substitutions or unexpected circumstances.

Event-specific obligations and remedies will be governed by the applicable client agreement.

22. WARRANTIES DISCLAIMER

To the fullest extent permitted by applicable law, the Site and its Content are provided on an “as is” and “as available” basis.

Arcane & Ivory does not make any express or implied warranty regarding the Site or general Site Content, including warranties concerning accuracy, availability, merchantability, fitness for a particular purpose or non-infringement.

This disclaimer does not exclude any warranty, condition or consumer right that cannot legally be excluded.

Any warranties or commitments concerning a purchased Product or Service will be those expressly stated in the applicable product listing, proposal, invoice or signed client agreement.

23. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Arcane & Ivory and its partners, employees, contractors, representatives and service providers will not be liable for indirect, incidental, special, punitive or consequential loss arising from or connected with:

  • your access to or inability to access the Site;

  • your reliance on general Site Content;

  • a third-party website, platform, vendor or service;

  • unauthorized access that occurred despite commercially reasonable safeguards;

  • lost data, business interruption, lost profits or lost opportunities; or

  • circumstances outside our reasonable control.

Where liability cannot legally be excluded, our total liability arising specifically from your use of the Site or purchase of a Product through the Site will be limited to the amount you paid to Arcane & Ivory for the Product or Service giving rise to the claim.

Liability arising from wedding planning, coordination, rentals or other Services provided under a signed client agreement will be governed by that agreement.

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

24. INDEMNITY

To the extent permitted by law, you agree to indemnify and hold harmless Arcane & Ivory and its partners, employees, contractors and representatives from third-party claims, damages, liabilities, costs and reasonable legal expenses arising from:

  • your unlawful or unauthorized use of the Site;

  • your material breach of these Terms;

  • content you submit without the necessary ownership or permission;

  • your infringement of another person’s intellectual property, privacy or other rights; or

  • your fraud, wilful misconduct or unlawful activity.

This section does not require you to indemnify Arcane & Ivory for losses caused solely by Arcane & Ivory’s own unlawful conduct.

25. EVENTS OUTSIDE OUR CONTROL

We will not be responsible for a delay or failure involving the Site that is caused by events outside our reasonable control, including internet outages, hosting failures, cyberattacks, natural disasters, severe weather, public emergencies, government actions, labour disruptions, transportation interruptions or failures of third-party providers.

Events affecting booked wedding or coordination Services will be addressed under the applicable client agreement.

26. SUSPENSION AND TERMINATION

We may suspend, restrict or terminate your access to the Site or a digital Product if:

  • you violate these Terms;

  • you misuse our intellectual property;

  • your payment is fraudulent, reversed or subject to an improper chargeback;

  • your conduct threatens the security or operation of the Site;

  • continued access could expose us or another person to legal liability; or

  • we are required to do so by law.

Provisions concerning intellectual property, payments, disclaimers, limitation of liability, indemnity, dispute resolution and governing law will continue to apply after termination where their nature requires it.

27. DISPUTE RESOLUTION

Before beginning legal proceedings concerning these Terms, you agree to provide Arcane & Ivory with written notice describing the dispute and the resolution you are requesting.

Notices must be sent to:

info@arcaneandivory.com

The parties will make reasonable, good-faith efforts to resolve the dispute informally.

If the dispute cannot be resolved informally, either party may propose mediation in Calgary, Alberta. Mediation will take place only if both parties agree to participate, and the parties will agree on the mediator and allocation of mediation costs.

Nothing in this section prevents either party from seeking urgent injunctive relief, pursuing a remedy within a legally required limitation period or using a consumer-protection process available under applicable law.

28. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Subject to any consumer right or mandatory jurisdiction that cannot legally be waived, disputes arising from these Terms or the Site will be submitted to the courts located in Calgary, Alberta.

29. RELATIONSHIP OF THE PARTIES

Your use of the Site does not create an employment, partnership, joint venture, agency, fiduciary or professional-advisor relationship between you and Arcane & Ivory.

A wedding-planning or service-provider relationship is created only through an applicable signed client agreement.

30. ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms as part of a business reorganization, sale, transfer or succession, provided that doing so does not reduce any rights that cannot legally be reduced.

31. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.

32. WAIVER

Our failure or delay in enforcing a provision of these Terms does not waive our right to enforce that provision later.

A waiver is effective only when it is clearly made in writing by Arcane & Ivory.

33. ENTIRE AGREEMENT

These Terms and our Privacy Policy form the entire agreement concerning your general access to and use of the Site.

Product listings, proposals, invoices, rental agreements and signed client agreements may create additional terms for specific Products or Services.

34. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our Site, Products, Services, business practices or legal obligations.

The revised Terms will be posted on this page with an updated “Last updated” date.

Changes apply from the date they are posted unless otherwise stated. Your continued use of the Site after revised Terms are posted means that you accept the revised Terms.

Changes to these website Terms will not retroactively replace the terms of a signed client agreement unless permitted by that agreement or agreed to in writing by the parties.
